Terms of Service

Welcome to Island Champs ("Platform," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Island Champs website, mobile applications, and all related services (collectively, the "Services").

By creating an account, accessing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use our Services.

Island Champs is operated under the Willaura Protocol, which establishes standards for digital platforms. By using our Services, you also agree to comply with the Willaura Protocol guidelines as they apply to user conduct and data handling.

To use our Services, you must:

• Be at least 13 years of age. Users between 13 and 18 years old must have parental or guardian consent to use the Services.
• Have the legal capacity to enter into a binding agreement.
• Not be prohibited from using the Services under applicable laws.
• Not have been previously suspended or removed from our Services.

For certain features, including ticket purchases and premium subscriptions, you must be at least 18 years old or have parental consent with a valid payment method.

To access certain features of our Services, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Keep your password secure and confidential.
• Accept responsibility for all activities that occur under your account.
• Notify us immediately of any unauthorized use of your account.

Island Champs uses Single Sign-On (SSO) authentication through the Willaura Protocol. By using SSO, you authorize us to access certain information from your connected accounts as described in our Privacy Policy.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for fraudulent or illegal purposes.

Island Champs provides a comprehensive platform for Caribbean sports, including:

• Live Streaming: Watch live broadcasts of Caribbean sporting events.
• News & Content: Access sports news, articles, and multimedia content.
• Event Calendar: View schedules for upcoming sporting events across the Caribbean.
• Ticket Sales: Purchase tickets to live sporting events.
• Community Features: Join clubs, participate in discussions, and connect with other fans.
• Athlete Profiles: Follow and support Caribbean athletes.

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time without prior notice. We are not liable for any modification, suspension, or discontinuation of the Services.

When using our Services, you agree NOT to:

• Violate any applicable laws, regulations, or third-party rights.
• Post or transmit content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity.
• Engage in any form of harassment, bullying, or discrimination based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, or any other protected characteristic.
• Upload or transmit viruses, malware, or any other malicious code.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Use automated systems (bots, scrapers, etc.) to access our Services without permission.
• Interfere with or disrupt the integrity or performance of our Services.
• Engage in any activity that could damage, disable, or impair our Services.
• Use our Services for any commercial purpose without our express written consent.
• Record, redistribute, or rebroadcast any live streams without authorization.
• Circumvent any technological measures we use to protect our content.

Our Services allow you to post, submit, and share content, including comments, forum posts, and profile information ("User Content"). By posting User Content, you:

• Retain ownership of your User Content.
• Grant Island Champs a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display your User Content in connection with our Services.
• Represent and warrant that you own or have the necessary rights to post your User Content and that it does not violate any third-party rights.
• Acknowledge that User Content may be viewed by other users and the public.

We reserve the right to remove any User Content that violates these Terms or that we find objectionable, without prior notice. We are not responsible for any User Content posted by users.

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, and software, are the exclusive property of Island Champs, its licensors, or content providers and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

The Island Champs name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Island Champs or its affiliates. You may not use these marks without our prior written permission.

You are granted a limited, non-exclusive, non-transferable license to access and use our Services for personal, non-commercial purposes. This license does not include the right to:

• Modify or copy our materials.
• Use our materials for any commercial purpose.
• Attempt to reverse engineer any software contained in our Services.
• Remove any copyright or proprietary notations.
• Transfer the materials to another person or "mirror" the materials on any other server.

Certain features of our Services may require payment, including premium subscriptions and pay-per-view events. By making a purchase, you agree to:

• Provide accurate and complete payment information.
• Pay all charges at the prices in effect when incurred.
• Pay any applicable taxes.

Subscriptions

Subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period.

Refunds

Subscription fees are generally non-refundable, except where required by law. For pay-per-view events, refunds may be available if the event is cancelled or significantly altered. Refund requests must be submitted within 7 days of the purchase.

Price Changes

We reserve the right to change our prices at any time. Price changes for subscriptions will take effect at the start of the next billing cycle following notice of the change.

Our live streaming services are subject to the following additional terms:

• Geographic Restrictions: Some content may be restricted based on your geographic location due to broadcasting rights agreements.
• Quality: Stream quality may vary based on your internet connection and device capabilities. We do not guarantee any specific quality level.
• Availability: Live streams may be subject to delays, interruptions, or cancellations due to technical issues or circumstances beyond our control.
• Recording Prohibition: You may not record, capture, or redistribute any live stream content without express written permission.
• Concurrent Streams: Your account may have limits on the number of concurrent streams allowed.

We are not liable for any inability to access live streams due to technical issues, geographic restrictions, or other factors.

When purchasing tickets through our platform:

• Ticket Sales: All ticket sales are final unless the event is cancelled or rescheduled.
• Event Changes: Event organizers reserve the right to change event dates, times, venues, or lineups. We will notify you of significant changes when possible.
• Cancelled Events: If an event is cancelled, you will be eligible for a refund of the ticket price. Processing fees may not be refundable.
• Rescheduled Events: Tickets for rescheduled events will typically be valid for the new date. Refunds may be available if you cannot attend the rescheduled event.
• Resale: Resale of tickets may be prohibited or restricted. Check the specific event terms.
• Entry Requirements: You are responsible for meeting all entry requirements set by the event organizer.

Island Champs acts as an intermediary for ticket sales and is not responsible for the event itself. All disputes regarding event quality or experience should be directed to the event organizer.

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using our Services, you consent to the collection, use, and sharing of your information as described in our Privacy Policy. Key points include:

• We collect information you provide directly and information collected automatically through your use of our Services.
• We use your information to provide, maintain, and improve our Services.
• We may share your information with third parties as described in our Privacy Policy.
• You have certain rights regarding your personal information, including the right to access, correct, and delete your data.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by law, Island Champs disclaims all warranties, express or implied, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Warranties that the Services will be uninterrupted, error-free, or secure.
• Warranties regarding the accuracy, reliability, or completeness of any content.
• Warranties that defects will be corrected.

We do not warrant that our Services will meet your requirements or expectations. Any reliance on our Services is at your own risk.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ISLAND CHAMPS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

This includes, without limitation, damages for:

• Loss of profits, revenue, or data.
• Business interruption.
• Loss of goodwill.
• Personal injury or property damage.
• Any other damages arising from your use of our Services.

In no event shall our total liability exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) $100 USD.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless Island Champs and its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms.
• Your User Content.
• Your use of our Services.
• Your violation of any rights of another party.
• Your violation of any applicable laws or regulations.

We may terminate or suspend your account and access to our Services immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms.
• Fraudulent, abusive, or illegal activity.
• Non-payment of fees.
• Extended periods of inactivity.
• Requests by law enforcement or government agencies.

Upon termination:

• Your right to use our Services will immediately cease.
• We may delete your account and User Content.
• Any fees paid are non-refundable unless required by law.
• Provisions that by their nature should survive termination will survive.

You may terminate your account at any time by contacting us or using the account deletion feature in your settings.

These Terms shall be governed by and construed in accordance with the laws of Saint Lucia, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or our Services shall be resolved through:

1. Informal Resolution: We encourage you to contact us first to resolve any disputes informally.
2. Mediation: If informal resolution fails, disputes may be submitted to mediation.
3. Arbitration: Disputes not resolved through mediation shall be settled by binding arbitration in accordance with the laws of Saint Lucia and the Eastern Caribbean Supreme Court jurisdiction.

You agree to waive any right to a jury trial or to participate in a class action lawsuit against Island Champs.

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last Updated" date at the top of these Terms.
• For material changes, we will provide notice through our Services or by email.
• Your continued use of our Services after changes become effective constitutes acceptance of the revised Terms.

If you do not agree to the revised Terms, you must stop using our Services and may request deletion of your account.
